I.               FIELDS OF APPLICATION

 

The company Audio-Vidéo-Média (A.V.M) (hereinafter referred to as "AVM"), SAS with capital of 439 875€, whose head office is located at ZAC des Charmes 11 boulevard de l'Hippodrome 71600 PARAY LE MONIAL, represented by Mr. Hubert de TORCY, exploits the mobile app EMMASONGS (hereinafter referred to as "Service").

 

AVM is particularly attached to respect for your private life and the protection of personal data.

 

The present privacy policy aims to inform you of how AVM collects, uses and discloses personal data when you use our Service and the choices available to you about such data.

 

AVM may update this policy considering legal, regulatory or CNIL policy developments.

II.              DEFINITIONS

By Service we mean the mobile app exploited by AVM.

 

Personal Data means data relating to a living individual who can be identified from such data (or from such data and other information in our possession or likely to come into our possession).

 

Usage Data is collected automatically and is generated either by use of the Service or by the Service infrastructure itself (for example, duration of consultation of a page).

III.             CONTROLLER FOR TREATMENT AND COMMITMENT

 

The controller for processing your personal data for digital media is AVM (hereinafter referred to as the "Controller").

 

The Data Controller undertakes to collect and process your personal data in accordance with the provisions of Law No. 78-17 of 6 January 1978 known as the “Informatique et Libertés” law and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on data protection (hereinafter "GDPR").

IV.            COLLECTED DATA

 

The Controller ensures the collection and processing of personal data that is relevant, adequate, not excessive, and strictly necessary to achieve the purposes for which they are processed.

The controller may need to collect different categories of personal data, in particular without this list being exhaustive:

·       Contact details (email)

·       Usage Data

When you access the Service by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data ("Usage Data").

V.             PURPOSES AND LEGAL BASIS OF DATA COLLECTION

 

The Controller informs you that your personal data will be processed, according to the methods of collection and the nature of the interactions with the persons concerned, for the following purposes:

 

·       Provide and ensure our Service

·       Provide customer support in the context of the commercial relationship between AVM and the customer

·       Detect, prevent, and resolve technical problems

These treatments have as a legal basis: the execution of a contract or pre-contractual measures.

VI.            PERIOD OF CONSERVATION OF PERSONAL DATA

 

The Data Controller only keeps your personal data for the time necessary for the purposes for which they were collected and this, in accordance with the legislation in force. The Data Controller may, however, keep your personal data for a longer period in particular to comply with legal obligations or for proof purposes.

VII.           DATA RECIPIENTS

 

Access to personal data is limited to the internal services of the Controller and his subcontractors with whom the Controller is contractually bound to achieve the purpose of the processing. They are not communicated to third parties, except in the following cases:

Ø  when you have given your prior consent for sharing

Ø  when it turns out to be a legal obligation

VIII.         SECURITY AND STORAGE OF YOUR DATA

The Manager is particularly attached to the security of the personal data he processes and collects. These operations are performed securely. We implement the necessary technical, physical, and organizational measures to prevent, as far as possible, any alteration, loss, or unauthorized access to your personal data.

Personal data is stored in the European Union in databases or files managed by the Controller or in those of service providers with whom the Manager has a dedicated contractual relationship.

IX.            LINKS TO OTHER SITES

Our Service may contain links to other sites that we do not operate. If you click on a third-party link, you will be redirected to that third-party's site. We strongly recommend that you review the privacy policy of each site you visit.

We have no control over the content, privacy policies or practices of any third-party sites or services and are not responsible for them.

X.             DATA TRANSMISSION AND SUBCONTRACTORS

Under no circumstances does AVM sell, trade, or rent your personal data to third parties.

The personal data collected about you are used only by AVM. However, in the context of our activity, AVM may call on subcontractors who may receive communication of your personal data. Where applicable, AVM ensures the compliance of all its subcontractors with respect to the requirements of the GDPR and case law.

AVM has entered into a personal data subcontracting agreement with its subcontractor to ensure that the personal data you entrust to us are treated with the same level of standards as our services.

In addition, AVM does not disclose your personal data to third parties, except if:

Ø  You request it or authorize its disclosure,

Ø  AVM is compelled to do so by a governmental authority or regulatory body, in the event of a judicial requisition, subpoena or other similar governmental or judicial request, to establish or defend a legal claim,

Ø  The third-party acts as an agent or partner of AVM in performing the services.

XI.            EXERCISE OF PERSONAL RIGHTS

 

You have, under the conditions determined by the applicable legislation, a right of access, rectification, erasure, limitation of processing, data portability.

 

You also have the right to object to the processing of your personal data.

XIII.         CHANGES TO THIS PRIVACY POLICY

We reserve the right to update our Privacy Policy at any time, in particular in application of changes to the laws and regulations in force. We will notify you of any changes by posting the new Privacy Policy on this page.

Changes made will be notified via a prominent notice in our Service. This notification will include a link allowing you to access the amended privacy policy, and this for a reasonable period of time. We can also communicate about this change by any other means of information that we deem useful and appropriate.
